CDPAP FAQs

Most family members can serve as personal assistants and get paid to provide care under the CDPAP program, except (1) Spouse, (2) Parent caring for a child under 21, (3) Designated representative.

As a lead FI, Xincon is responsible for processing and paying Personal Assistant\'s wages and benefits, as well as all applicable income tax and other required wage withholdings, including Social Security and Federal, State and Local taxes.

The New York Department of Health has instituted a consolidation of all the agencies providing fiscal intermediary services. There used to be over 1000+ agencies, now there are only about 70 across the State. An agency which is approved by the New York State Department of Health is called \"Lead FI\". A list of approved Lead FIs can be found here.  If your original FI agency was not approved as a \"Lead FI\" by the Department of Health, then the consumer you care for will need to choose a new \"Lead FI\" in order to maintain and process your wages and benefits.

First, you will need to check whether the FI is approved to be a Lead FI by New York State Department of Health. If a consumer\'s FI was not approved by the State of NY as a Lead FI, that agency must stop providing FI services (i.e. paying your salary). It is imperative that all consumers choose a Lead FI before their current FI ceases its FI operations, to ensure no interruption in services/payments to consumers and personal assistants.
